In any case, the User undertakes to make appropriate use of the content and services offered by GRUPOTEC through the Portal, including but not limited to:

(i) engage in activities that are illicit, illegal or contrary to good faith and public order.

(ii) Not to introduce, store or disseminate on or from the Portal any information or material that is explicitly or implicitly defamatory, libellous, obscene, threatening, xenophobic, in support of terrorism, pornographic or incites violence, discrimination based on race, sex, ideology, religion or that in any way violates morality, public order, fundamental rights, public freedoms, with special attention to the honour, privacy or image of third parties and, in general, human rights.

(vii) Not to use the services offered on the Portal for the purpose of promoting external companies and services, other websites and advertising or commercial campaigns, or to act for the benefit of legal entities.

In the event of contravention of the above conditions, GRUPOTEC reserves the right and shall be entitled to block, suspend or cancel, immediately and without prior notice, access to and use of the Portal and, where appropriate, to remove alleged or declared illegal content, at its sole discretion, and at the request of the third party concerned or the competent authority.

3. Liability

GRUPOTEC shall not be liable for any damages that may arise from, by way of example and without limitation:

(i) Inferences, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operational functioning of this electronic system or in the Users’ computer apparatus and equipment, caused by causes beyond the control of GRUPOTEC, which prevent or delay the provision of the services or browsing of the System.

(ii) Delays or blockages in use caused by deficiencies or overloading of the Internet or other electronic systems.

(iii) That may be caused by third parties through unlawful interference beyond the control of and not attributable to GRUPOTEC.

(iv) The impossibility of providing the service or allowing access for reasons not attributable to GRUPOTEC, due to the User, third parties or force majeure.

4. Intellectual and industrial property

The source code, graphic designs, images, photographs, sounds, animations, software, texts, domain names, trademarks, as well as the information and content contained throughout the Portal are protected by Spanish legislation in favour of GRUPOTEC.

Their use, reproduction, distribution, public communication, transformation or any other similar or analogous activity is strictly prohibited without the express authorisation of GRUPOTEC.

5. Use of hyperlinks

Internet users who wish to introduce links from their own websites to the Web Page must comply with the conditions detailed below, without ignorance of these conditions avoiding the responsibilities derived from the Law.

The link will only link to the home page or main page of the Web Page but may not reproduce it in any way (inline links, copy of texts, graphics, etc.). Spanish legislation will be applicable to all litigious matters or those concerning https://www.grupotec.es, and the Courts and Tribunals of Valencia (Spain) will be competent for the resolution of all conflicts arising from or related to the use of this website. These Conditions of Use shall be governed by the provisions of Spanish law. In the event of any discrepancy or dispute arising from the interpretation or application of these Terms of Use, Grupotec and the User, expressly waiving any other jurisdiction that may correspond to them, submit to the jurisdiction of the Courts and Tribunals of the User’s domicile. In the event that the User is domiciled outside of Spain, expressly waiving any other jurisdiction that may correspond to them, they will submit to the jurisdiction of the Courts and Tribunals of Valencia (Spain).
